Terms of Service

Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of skateseek.com (the "Site"), operated by Nearby Ventures, LLC. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

Your Account

Browsing the skate park directory does not require an account. To submit skate parks, you must create an account with a valid email address.

  • You must be at least 13 years old (or 16 in the European Economic Area) to create an account. If you are under 18, you may only use the Site with the supervision of a parent or legal guardian who agrees to these Terms.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • Notify us immediately if you believe your account has been compromised.

User-Generated Content

You may submit skate park information, descriptions, and photos ("User Content") through the Site. By submitting User Content, you agree to the following:

  • Ownership: You retain all ownership rights to your User Content.
  • License grant: By submitting User Content, you grant Nearby Ventures, LLC a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, distribute, and create derivative works from your User Content in connection with the skate park directory. This license survives account deletion because submitted park data becomes part of the public directory.
  • Your representations: You represent that you own or have the necessary rights to submit the User Content, that it does not infringe any third-party rights, and that it is accurate to the best of your knowledge.
  • Moderation: We may review, edit, or remove User Content at our discretion for accuracy, safety, formatting, or any other reason. We use AI-powered content moderation to assist in this process.

Prohibited Uses

You agree not to:

  • Submit false, misleading, or intentionally inaccurate park information
  • Upload malicious content, spam, viruses, or illegal material
  • Scrape, crawl, or otherwise access the Site in a manner that degrades service for other users
  • Attempt to access administrative features or other users' accounts without authorization
  • Use the Site for unauthorized commercial advertising or solicitation
  • Harass, threaten, or harm other users
  • Circumvent any security measures or access controls
  • Use the Site for any purpose that violates applicable law

Intellectual Property

The Site's design, code, logos, and original content — including AI-generated park descriptions, city guides, and review summaries — are owned by Nearby Ventures, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without permission.

Park data aggregated from publicly available sources is presented as-is. Google Maps content displayed on the Site is subject to Google's terms.

AI-Generated Content

Some content on SkateSeek is generated or assisted by artificial intelligence, including city descriptions, review summaries, sentiment analysis, and content moderation decisions. AI-generated content may contain errors or inaccuracies. It is provided for informational purposes only and should not be relied upon as the sole source of truth about any skate park. Always verify important details independently before making decisions based on information found on this Site.

Third-Party Services

The Site uses third-party services including Google Maps, Google Analytics, Supabase, and Vercel. Your interaction with these services is governed by their respective terms and privacy policies. Links to external websites from the Site are provided for convenience and do not constitute endorsement.

Disclaimer of Warranties

THE SITE AND ALL PARK INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We make no warranties or representations about the accuracy, completeness, reliability, or currency of any park information displayed on the Site, including but not limited to: park existence, operating hours, physical conditions, safety, features, accessibility, rules, or entrance fees.

Park conditions change frequently. Parks close. Features get damaged or removed. Hours change. Rules are updated. Always verify information independently before visiting any skate park.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Assumption of Risk

Skateboarding and other action sports are inherently dangerous activities that carry a risk of serious injury or death. By using this Site to find skate parks, you acknowledge and accept the following:

  • You assume all risk associated with visiting any skate park found through this directory.
  • SkateSeek is an information directory only. We do not operate, maintain, inspect, endorse, or guarantee the safety of any skate park listed on this Site.
  • You are solely responsible for assessing park conditions, your own skill level, and the risks involved before skating or engaging in any activity at a park.
  • Information about park features (bowls, rails, ramps, etc.) is for general reference. Actual conditions may differ from what is described on this Site.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Nearby Ventures, LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM OR RELATED TO:

  • Your use of or inability to use the Site
  • Any reliance on park information, descriptions, reviews, or other content on the Site
  • Any injuries, property damage, or losses sustained at any skate park listed on the Site
  • Any errors or inaccuracies in AI-generated content
  • Any unauthorized access to or alteration of your account or data

Our total aggregate liability for all claims arising from or related to these Terms or the Site shall not exceed one hundred US dollars ($100.00).

Indemnification

You agree to indemnify, defend, and hold harmless Nearby Ventures, LLCand its owners, officers, employees, and agents from any losses, liabilities, damages, costs, claims, and expenses (including reasonable attorney's fees) arising from your use of the Site, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your account and access to the Site at any time, for any reason, without notice. You may delete your account at any time by contacting us. Upon termination, the following provisions survive: User-Generated Content license grant, Disclaimer of Warranties, Assumption of Risk, Limitation of Liability, Indemnification, and Governing Law.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Illinois.

Changes to These Terms

We may update these Terms from time to time. If we make changes, we will update the effective date at the top of this page. Your continued use of SkateSeek after any changes constitutes acceptance of the updated Terms. If you disagree with any changes, you should stop using the Site.
